Truck Driver Of Large Bottling Co. Terminated Due To Sleep Apnea

 Michael Sumpter from Harris County fights for his job with legal action after The American Bottling Co. and Dr. Pepper Snapple Group Inc. allegedly terminated him due to his sleep apnea condition. According to SETexasRecord.com, Sumpter has been diagnosed with sleep apnea and is receiving CPAP treatment. However, he finds it hard adjusting to CPAP and tends to sleep longer, resulting to frequent tardiness. Sumpter points out that other drivers were also being late but he was the only one terminated, which he presumes is due to his sleep apnea condition. He has been serving the company for 25 years. The law suit was filed last Nov. 26 in the Houston Division of the Southern District of Texas.
